These Terms and Conditions apply to all products and services provided by J.H & T.P Duncan Ltd. By placing an order with us you agree to these terms.
Customer Approval of Designs
It is the customer’s responsibility to ensure that the draft layout issued by J.H & T.P Duncan Ltd accurately reflects the memorial design requested. This includes checking all inscriptions, spellings, names, dates, layout, font styles, sizes and colours.
The final layout must be checked carefully, signed and returned before any work begins. Once approved, J.H & T.P Duncan Ltd cannot accept responsibility for errors unless they differ from the signed proof. Any alterations requested after approval may incur additional charges.
Granite and Marble
Granite and marble are natural quarried materials and may contain natural markings, blemishes, variations in colour or pattern. These characteristics are normal and do not affect the durability or quality of the memorial.
Samples and photographs are provided as a guide only and the final stone may vary slightly in appearance.
Photo Plaques and Etchings
The quality of photo plaques and etched images depends entirely on the clarity and size of the photograph supplied. While we may offer guidance, the final decision to proceed rests with the customer.
We cannot guarantee the safe return of original photographs supplied for reproduction.
Cemetery Regulations
All memorials must comply with the regulations of the relevant cemetery or churchyard authority. These regulations vary between locations and may change without notice.
While J.H & T.P Duncan Ltd will advise customers based on current regulations, we cannot accept responsibility if a memorial design, inscription or material is later rejected or requires alteration by the cemetery authority.
Any additional work required to meet cemetery regulations may incur additional charges.
Delivery and Installation
We aim to install memorials within approximately six to seven months from receipt of the deposit. However this timeframe depends on several factors including cemetery approvals, stone availability, shipping schedules and other circumstances outside our control.
Estimated installation dates cannot be guaranteed.
Memorial Safety and Ground Conditions
All memorials are installed in accordance with recognised industry fixing standards. However ground movement and soil settlement can occur naturally within cemeteries and churchyards.
J.H & T.P Duncan Ltd cannot be held responsible for movement, sinking or instability caused by ground conditions after installation. If a memorial requires re-levelling or resetting due to natural settlement, this may be chargeable.
Payment
A 50% deposit is required when placing an order for a new memorial. The remaining balance must be paid in full before installation.
Full payment is required when ordering additional works such as inscriptions, cleaning or repairs.
We accept payment by cash, debit card, credit card (excluding American Express) and BACS transfer.
Ownership of all goods remains with J.H & T.P Duncan Ltd until payment has been received in full.
Cancellation
Cancellation requests must be submitted in writing. A cancellation fee of 10% of the order value (excluding VAT) may apply to cover administrative costs.
Additional charges may apply if materials have already been ordered, manufactured or delivered.
Complaints
If you are dissatisfied with the memorial or services provided, please notify us in writing within 21 days of installation so we can investigate the matter promptly.

This process does not affect your statutory consumer rights.
Limitation of Liability
To the fullest extent permitted by law, J.H & T.P Duncan Ltd shall not be liable for any indirect or consequential loss arising from the supply, installation or maintenance of memorials.
Nothing in these Terms and Conditions shall limit or exclude liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
General
These terms are governed by the laws of England and Wales and any disputes shall be subject to the jurisdiction of the English courts.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force.
J.H & T.P Duncan Ltd reserves the right to update these Terms and Conditions from time to time. Your statutory consumer rights are not affected.
